Orbyss is a travel eSIM provider providing eSIM data plans for travellers across the globe. Please read these Terms and Conditions carefully before purchasing an eSIM data plan from Orbyss. By completing a purchase, you confirm that you have read, understood and agreed to these Terms in conjunction with our AUP.

1 . Eligibility

1.1 You must be at least 18 years of age to purchase from Orbyss.

1.2 You are responsible for ensuring that your device is eSIM compatible before purchasing. A list of compatible devices is available on our website. We cannot be held responsible for purchases made on incompatible devices.

1.3 eSIM plans are intended for consumer use only, on personal devices. They must not be used for IoT devices, fixed wireless access, or any commercial resale purpose. Bulk messaging, automated dialling, or SIM gateway applications are also prohibited.

2. Products and Plans

2.1 Orbyss offers prepaid eSIM data plans for 211+ destinations worldwide. Each destination may offer between 2 and 5 data plan variants, varying by data allowance and validity period.

2.2 Data plan details — including data allowance, validity period, and price — are clearly displayed at the point of purchase. It is your responsibility to select the plan that best suits your needs.

2.3 Our recommended plan is provided as a guide based on your stated trip duration. This recommendation is not binding and we accept no liability if the recommended plan does not meet your requirements.

2.4 All prices are displayed in GBP and are inclusive of applicable taxes unless stated otherwise.

3. Purchasing

3.1 By completing a purchase on the Orbyss website, you are entering into a legally binding contract with us for the supply of a digital product.

3.2 You will receive a confirmation email containing your QR code and installation instructions following a successful payment. Please check your spam or junk folder if you do not receive this within 30 minutes of purchase.

3.3 Orbyss reserves the right to refuse or cancel any order at its sole discretion, including in cases of suspected fraud or misuse.

4. Delivery and Activation

4.1 Your eSIM is delivered digitally via an email QR code or link sent to the email address provided at checkout. No physical product will be dispatched.

4.2 Your data plan validity period begins upon first use of data on the eSIM, or within the validity period of the QR code being issued, whichever is sooner.

4.3 You are responsible for installing the eSIM correctly on your device. Installation instructions are provided with your QR code. Orbyss accepts no liability for failed installations caused by user error or device incompatibility.

4.4 Your QR code can only be used once. Once scanned and installed, it cannot be transferred to another device.

5. Data Allowance and Expiry

5.1 Each data plan has a fixed data allowance and a fixed validity period as described at the point of purchase.

5.2 Unused data does not roll over. Once your validity period expires, any remaining data allowance is forfeited. Data plans cannot be paused, extended, or transferred to another plan or device.

5.3 Once your data allowance is fully consumed, data access will cease. You will need to purchase a new plan to continue using data.

6. Network Coverage

6.1 Orbyss eSIM plans provide access to mobile data networks via roaming agreements with local network operators in each destination country.

6.2 Network coverage, speed, and reliability are determined entirely by the local telecommunications infrastructure and network operators in each country or region. Orbyss has no control over local network conditions and cannot guarantee coverage, signal strength, or data speeds in any specific location. Our fixed price plans promise 5G connection where available.

6.3 Coverage may be limited or unavailable in remote, rural, or mountainous areas, underground locations, aboard vessels or aircraft, or in countries with restricted telecommunications infrastructure.

6.4 Orbyss accepts no liability for loss of service, reduced speeds, or lack of coverage caused by local network conditions, geographic limitations, or network operator decisions.

6.5 Indicative coverage information is available on our website and through our coverage checker tool. This information is provided in good faith based on data supplied by our network partners and is subject to change without notice.

7. Refunds and Cancellations

7.1 As our eSIM plans are digital products delivered immediately upon purchase (via QR code), your right to cancel under the Consumer Contracts Regulations 2013 is waived once the QR code has been issued and you have confirmed your agreement to immediate delivery.

7.2 No refunds will be issued for:

Partially used data plans
Expired data plans
Plans where the QR code has been successfully scanned and installed
Purchases made on incompatible devices
Poor coverage or network performance in a destination country

7.3 Refunds may be considered at our discretion in the following circumstances:

The QR code was not delivered to your email address and cannot be resent
A confirmed technical fault on our part prevented activation of the eSIM
A duplicate purchase was made in error and neither QR code has been installed

7.4 To request a refund under clause 7.3, please contact us at support@orbyss.co.uk within 14 days of purchase with your order reference.

8. Acceptable Use

8.1 Our eSIM plans are intended for personal travel use on consumer mobile devices only.

8.2 You must not use our eSIM plans for any unlawful purpose, or in any way that violates the terms of the underlying network operators.

8.3 eSIM plans must not be used in the same country for more than 60 consecutive days. Permanent roaming detection is in place and we reserve the right to suspend or terminate service where prolonged use in a single country is detected.

8.4 You must not attempt to resell, transfer, or share your eSIM or data allowance with third parties for commercial gain.

9. Limitation of Liability

9.1 To the fullest extent permitted by law, Orbyss shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our eSIM plans, including but not limited to loss of data, loss of business, or costs incurred due to lack of connectivity.

9.2 Our total liability to you for any claim arising from a purchase shall not exceed the amount paid by you for that specific order.

9.3 Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.

10 Privacy

10.1 We collect and process personal data in accordance with our Privacy Policy, available on our website. By purchasing from Orbyss, you consent to the processing of your data as described therein.

10.2 We do not sell your personal data to third parties, or have access to communication content or Call Data records.

11. Intellectual Property

11.1 All content on the Orbyss website, including but not limited to text, graphics, logos, and software, is the property of Orbyss and is protected by applicable intellectual property laws. You may not reproduce or distribute any content without our express written permission.

12. Governing Law

12.1 These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.

12.2 Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales
